On December 21, 2011, OMLCIA received a letter from the Indiana DNR reminding the Association that it is not allowed to alter the lake water level, and that the outlet structure, the dam on 50E, should be maintained in its original condition. This letter came as a result of temporary boards, which were inserted with DNR permission, being placed in the structure to alleviate low lake levels. The DNR later rescinded its permission and informed the Association that any future modifications or tampering to that lake outlet structure would be viewed as a violation of the Lake Preservation Act.
